TERMS AND AGREEMENT

All services are ordered as requested in shopping cart, and as outlined with product details. Client agrees to pay all fees associated with requested work.

FEES
Payment is due in full prior to services being rendered. APEX Career Services will not commence any service without payment of fees in full. Fees for services are neither cancelable nor refundable.

RESUME AND PROFESSIONAL LETTER & DOCUMENT SERVICES Client agrees to complete questionnaire, answer questions, and provide as much information as possible in order to create great resume and professional letter & document services. Resume service fees include a review of completed questionnaire and supporting documentation, up to 15 minutes interview by phone, discussion of writing strategy, and two requests for edits by client before completion. Letter and documentation service fees include a review of supporting documentation, up to 15 minutes interview by phone, discussion of writing strategy, and one requests for edits by client before completion. Additional fees may apply for follow up with client to obtain completed and requested information. The content and suggested format of the Resume and professional document is determined based on your unique needs, and are discussed upfront. Any additional re-working or re-formatting may be assessed additional fees, depending on the complexity. Client agrees to return Proofreading Agreement with requests for edits or provide approval to finalize as presented in draft, within the timeframe requested in email accompanying draft. Failure to do so will cause delays and prevent your project from being completed within deadline.  It is your responsibility to respond timely as requested to ensure your project stays on task.  If Proofreading Agreement is not returned as requested, it is assumed that draft is acceptable and the final document will be sent to the client.

APEX Career Services is not responsible for information obtained from client that is inaccurate or incorrect. Client is responsible for providing accurate and factual information. APEX Career Services’ liability is limited to the completion of work. APEX Career Services assumes no liability after Resume and professional letter & document has been proofread and Proofreading Agreement has been signed and/or agreed to by email or phone. It is agreed that in the event of any legal action, the laws of Kansas will apply, that venue will lie in Johnson County, Kansas, and only the courts located there will have jurisdiction over the parties. Client agrees to have any work created on his/her behalf to be used by APEX Career Services in publications, books, websites, and/or lectures created by APEX Career Services, or authorized for use by APEX Career Services. Client information such as names, addresses, phone numbers, and email addresses will be changed to protect client’s privacy. Turnaround time varies depending on the product you choose, and your prompt response with your requests for edits.

COACHING/ CONSULTING SERVICES

The format for career coaching involves telephone coaching sessions as agreed upon between APEX Career Services and the client. Coaching time includes contact time, preparation, analysis, and follow up. All coaching sessions are conducted by telephone, and client is responsible for telephoning APEX Career Services at agreed times arranged via email or phone, unless instructed otherwise by your career coach. Coaching sessions are in 30 minutes or 1 hour increments, unless otherwise specified by your coach or coaching special offers. The date and time of the first session and any subsequent sessions will be agreed between APEX Career Services and client by phone or email. Between Sessions APEX Career Services may assign the client tasks or exercises to complete. There is no obligation for client to complete assignments, but failure to do so may slow client’s progress in achieving desired outcomes. Where possible, client is requested to submit information requested by APEX Career Services relating to assignments at least 24 hours prior to next scheduled coaching session. APEX Career Services will provide feedback on completed assignments during coaching sessions. The client may contact APEX Career Services by phone or e-mail in between sessions to seek clarification regarding any questions arising from a coaching session or for administrative purposes. Client is required to provide at least 24 hours’ notice to reschedule or cancel a scheduled appointment to avoid being charged for the session. No refunds or reschedules will be allowed for unused coaching sessions unless 24 hours’ notice has been given.  No shows, not calling at your scheduled time, or not being available at the scheduled time of call is considered a cancellation by client without notice. In exceptional circumstances APEX Career Services may need to rearrange a coaching session. In those instances APEX Career Services will also give client 24 hours’ notice. Personal information or business information supplied by clients in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client’s written permission, save where required by law or where action might be necessary to prevent harm to the client or someone else. Coaching services are non-cancelable and non-refundable. Apex Career Services is committed to your success and satisfaction. Please notify us by email or phone within 24 hours of completion of a coaching session if you have a concern and we will address your concern within 24 hours of receipt. The client and APEX Career Services each has the option to non-renew upon completion of pre-paid sessions by confirming such termination by email. If either party does terminate this agreement in such circumstances APEX Career Services will have no obligation to provide further coaching sessions. In exceptional circumstances, such as illnesses or unavailability due to bereavement or other critical circumstances, APEX will work with client to reschedule appointments at no additional fees. Inappropriate behavior or offensive language by client towards employees of APEX Career Services is a gross violation and will result in refusal of services and forfeiture of a refund. APEX Career Services aims to assist client in achieving desired outcomes. Results can be achieved when client follow a clear plan in a committed way. Client has sole responsibility for his/ her actions and outcomes. APEX Career Services assumes no liability for any loss incurred by any client, whether financial or otherwise, during and following coaching sessions, or for any perceived failure by the client, whether justified or otherwise. Should client no longer wish to proceed with further coaching sessions, client may withdraw from services immediately by giving notice by email. The will be no refunds as all sales are final. It is agreed that in the event of any legal action, the laws of Kansas will apply, that venue will lie in Johnson County, Kansas, and only the courts located there will have jurisdiction over the parties. APEX Career Services reserves the right to change or modify these terms and conditions at any time.

LINKEDIN PROFILE WRITING
Client agrees to complete questionnaire if requested, provide an updated Resume, answer questions in an interview when requested, and provide as much information as possible in order to create a LinkedIn profile. Client agrees to provide APEX Career Services with all tools and information necessary to complete profile writing. Service includes review of Resume and all supporting documentation, up to a 15 minutes phone interview, discussion of strategy, and complete keyword optimized profile writing. The content and suggested format of the LinkedIn page is discussed upfront. Any additional re-working or re-formatting may be charged additional fees, depending on the complexity. Client agrees to return prompt feedback with approval/changes via email within same day of request. If feedback is not provided by then, it is assumed that the profile is acceptable and the project will be finalized.

APEX Career Services is not responsible for information obtained from client that is inaccurate or incorrect. Please be accurate with your titles, job descriptions, dates, education and activities. APEX Career Services’ liability is limited to the completion of work. APEX Career Services assumes no liability after LinkedIn page has been proofread we receive email approval from you. It is agreed that in the event of any legal action, the laws of Kansas will apply, that venue will lie in Johnson County, Kansas, and only the courts located there will have jurisdiction over the parties. By signing this agreement, you agree to have any work created used in any publications, books, websites or lectures created by APEX Career Services. Names, addresses, phone numbers, and email addresses will be changed to protect client’s privacy.

Please Note:
All Resume writing services (except Resume Review & Feedback and Resume Proofreading & Editing) include 2 edit requests before completion. Resume Proofreading & Editing and Resume Review & Feedback services do not include edit requests.  All Letter and Document services include 1 edit request. Free cover letter and free thank you letter provided with any resume, CV, or professional Bio service does not include edit request. You can upgrade any free letter by purchasing at full price in order to get one edit request. It is your responsibility to conduct detailed reviews and provide your request for edits timely. Edits requested after we finalize your approved Resume, cover letter, and documents will incur additional fees. Client has 2 weeks to respond and provide requests for edits to drafts sent for writing projects such as resumes, cover letters, thank you letters, bios, etc. Client agrees to submit edits requests for drafts received within 2 weeks of receiving first draft. Lack of response implies that no changes are required by client. If Proofreading Form is not returned by then for all drafts, it is assumed the most recent draft received is acceptable as-is, and the final document will be emailed in Microsoft Word on the 14th day from receipt of the original draft sent.

All services expire 60 days from date of purchase. Client forfeits the rights to any services not used by client within 60 days, unless approved in writing by APEX Career Services prior to the expiration date. All sales are final. There will be no refunds. However, we will reschedule appointments with 24 hours written notice or request to reschedule or cancel appointment or service.

You are responsible for proofreading all drafts and for returning your approved proofreading agreements. Email communications approving drafts are considered approved Proofreading Agreements.

APEX Career Services’ liability is limited to the completion of work. APEX Career Services assumes no liability for services that have been completed with your approval. It is agreed that in the event of any legal action, the laws of Kansas will apply, that venue will lie in Johnson County, Kansas, and only the courts located there will have jurisdiction over the parties.

Client agrees to pay an additional fee of $50.00 on all returned checks, plus legal and collection fees. Client agrees to have all work created by APEX Career Services LLC used in any publications, books, websites or lectures created by APEX Career Services. Names, addresses, phone numbers, and email addresses will be changed to protect Client’s identity.

ASSESSMENTS
Assessment results are a direct results of the responses you provide. Clients are strongly urged to be completely honest in responding to assessment questions. Client is responsible 100% for the results of the assessments.  APEX Career Services and its representatives are not liable for the results of client’s assessment. Clients accepts full responsibility for the outcome of the assessments. Client agrees to not hold APEX Career Services or its representatives responsible for the outcomes.

TARGETED RESUME DISTRIBUTION
Services are rendered as outlined in detailed product description.  Client agrees to partner with APEX Career Services, as requested, in an effort to ensure maximum success of the resume distribution and job search campaign process.  APEX Career Services does not guarantee that client will be interviewed or hired as a result of positions submitted to. Clients accepts full responsibility for the outcome of the job search campaign. Client agrees to not hold APEX Career Services or its representatives responsible for lack of interviews, failure to get hired, or any other related outcomes.

PROOFREADING & EDITING
The client agrees to the fee structure and terms quoted on the Academic Proofreading & Request Form and the paid invoice. The client understands that all payments are final, and no refunds exist. The proofreading and editing service does not apply to resumes or other projects. This project applies only to academic writing projects. The normal turnaround time is five business. We offer same-day and next-day rush for an extra fee. Coaching is a separate service with a separate fee.

ADDITIONAL INFORMATION

Clients grant Nadine Franz, APEX Career Services LLC, and its representatives permission to publish all work product performed. This includes information about resumes, coaching sessions, and all other services provided. Your personal data will never be shared with anyone as your privacy is important.

AGREEMENT
It is agreed that in the event of any legal action, the laws of Kansas will apply, that venue will lie in Johnson County, Kansas, and only the courts located there will have jurisdiction over the parties.

By making a purchase from APEX Career Services LLC you as payer and/or client agree to the terms and conditions as outlined. These terms apply for purchases made on our secure website or invoiced through PayPal, Google Wallet, Venmo, in-person via credit card swipe, or by other means agreed to by email, fax or in-person signature.
